“Soft tissue injury” is the umbrella term for damage to muscles, tendons, ligaments and other tissues that are not bone. It includes whiplash, back strains, sprained wrists and ankles, bruising and myofascial pain. These are the most common injuries in California crashes and account for the majority of injury claims. They are also the claims insurers most systematically discount, using software and internal guidelines that assign low values to injuries without imaging findings.

What soft tissue injuries include

  • Sprains: stretching or tearing of ligaments (neck, back, wrist, ankle, knee). Graded I–III by severity.
  • Strains: stretching or tearing of muscles or tendons.
  • Contusions: deep bruising, including seat-belt bruising across the chest and abdomen, which can mask internal injury.
  • Myofascial pain and trigger points: persistent muscle pain that often follows whiplash-type injuries.
  • Temporomandibular (jaw) injury: from clenching or impact.

The term is a description, not a severity grade. A Grade III ligament tear is a soft tissue injury; so is a mild strain. Many people whose initial diagnosis was “soft tissue” are later found to have disc herniations or joint tears when symptoms persist and MRI is performed. See herniated discs and shoulder and knee injuries.

Why these claims are disputed

Soft tissue injuries are diagnosed by history and examination rather than by a scan, which lets insurers characterize them as subjective. Low vehicle damage, gaps in treatment, treatment that continues longer than the adjuster’s guideline, and treatment primarily by chiropractors rather than physicians are each used to reduce offers. Some insurers use claim-evaluation software that produces a value range from coded medical records; the inputs are the diagnoses, treatment types and durations, and documented complaints.

How to document a soft tissue injury properly

  1. Be seen promptly by a physician.

A documented diagnosis in the first days anchors the claim.

  2. Describe every area that hurts, and how it limits you.

Records that capture function (“cannot turn head to check blind spot,” “unable to lift toddler”) carry more weight than pain scores alone.

  3. Follow through on referrals and therapy, and do not skip appointments.
  4. If symptoms persist past four to six weeks, ask about further evaluation.

Persistent symptoms warrant a specialist and possibly MRI; what was “soft tissue” may be more.

  5. Keep work records.

Missed days, modified duty and employer notes are objective evidence of impact.

How soft tissue claims are valued

Reasonable medical expenses, lost wages and non-economic damages for the pain and disruption during recovery. Claims typically resolve within a range tied to treatment duration and documented impact. California law does not use a formula; a jury may award what it finds reasonable. The practical reality is that well-documented claims with consistent treatment settle for more than poorly documented ones with the same injury.

Common questions

The adjuster offered a small amount a week after the crash. Should I take it?

Early offers are made before the extent of injury is known. Accepting a settlement releases all claims from the crash, including injuries diagnosed later. Most people wait until they have completed treatment or reached a stable condition.

Is it true that insurers use software to value soft tissue claims?

Several major insurers use claim-evaluation software. It produces a range based on coded records; it is a negotiating tool, not a legal limit. Thorough documentation improves the inputs.

I only went to a chiropractor. Is my claim weaker?

Chiropractic treatment is legitimate care and compensable. Claims are generally stronger when a physician documented the initial diagnosis and when treatment is proportionate to the injury. Consider seeing a medical doctor at least for the initial evaluation.
