Spinal Cord Injury Claims in San Diego
Updated . General information, not legal advice about your situation.
Legal review: Elham Azimy, California State Bar No. 207274 (law and claims only).
San Diego’s high-speed freeway crashes, heavy motorcycle population and pedestrian collisions produce a steady number of spinal cord injuries each year—injuries that permanently change a person’s mobility, independence and finances. The region has strong acute and rehabilitation care for SCI, including programs serving the large military and veteran population. A claim for a San Diego spinal cord injury must capture a lifetime of needs, and it must find insurance adequate to pay for them.
How San Diego crashes cause spinal cord injury
- Rollovers and high-speed crashes on the I-5, I-15, I-805 and I-8, including wrong-way and DUI collisions late at night.
- Motorcycle collisions, where ejection and impact produce thoracic and cervical fractures. See San Diego motorcycle accidents.
- Pedestrian collisions on El Cajon Boulevard, University Avenue and the arterials of Mid-City and the South Bay.
- Side-impact collisions at wide suburban intersections.
- Rear-end hyperextension injuries in older adults with cervical spondylosis, producing central cord syndrome without fracture.
Acute care and rehabilitation in San Diego
Suspected spinal injuries are immobilized by San Diego Fire-Rescue paramedics and transported under the county trauma system to UC San Diego Health Hillcrest or Scripps Mercy (Level I), or Scripps La Jolla, Sharp Memorial or Palomar (Level II), where imaging, stabilization and decompression surgery follow. Rehabilitation is where function is determined: Sharp Rehabilitation Center in Kearny Mesa has a CARF-accredited spinal cord injury program; UC San Diego Health provides inpatient rehabilitation; and the VA San Diego Healthcare System operates a Spinal Cord Injury Center in La Jolla for veterans, one of the VA’s regional SCI hubs. Rehabilitation records, the ASIA Impairment Scale classification over time and the discharge care plan are the foundation of the claim.
Lifetime costs and the life-care plan
The National Spinal Cord Injury Statistical Center estimates lifetime costs from roughly $1.7 million for incomplete motor function to more than $5 million for high tetraplegia for a person injured at 25, excluding lost earnings. San Diego’s housing costs raise the home-modification and accessible-housing components. A life-care plan prepared by a qualified planner itemizes attendant care, equipment and replacement cycles, medications and supplies, home and vehicle modification, therapy and treatment of secondary complications, and an economist reduces those costs to present value along with lost earning capacity.
Finding adequate insurance
No private driver’s policy covers a spinal cord injury. The search includes the at-fault driver’s liability and umbrella policies; your own and household UIM coverage (which must be preserved by obtaining consent before settling with the at-fault driver); employers of drivers working at the time; commercial and rideshare policies; MTS, NCTD, the City of San Diego, the county and Caltrans (six-month government claim deadline) where public vehicles or dangerous road conditions were involved; the federal government under the Federal Tort Claims Act where a military or federal driver was at fault (two-year administrative claim); and manufacturers where seat belts, airbags, seat backs or roofs failed. See catastrophic injuries.
Military and veteran considerations
Active-duty service members injured in San Diego crashes are treated at Naval Medical Center San Diego (Balboa) or civilian trauma centers; Tricare and the government have recovery rights against the settlement. Medical retirement and VA disability processes run alongside the civil claim, and the interaction between VA benefits and a settlement should be planned. Veterans may receive lifetime SCI care through the VA, which affects the life-care plan’s structure but not the defendant’s liability for the harm.
Protecting public benefits
People with SCI frequently rely on Medi-Cal, In-Home Supportive Services, SSI and Section 8. A lump-sum settlement can disqualify them unless placed in a special needs trust or structured appropriately. Medi-Cal and Medicare reimbursement claims must be resolved from the settlement. Structured settlements providing guaranteed lifetime payments are common in these cases.

San Diego questions
My son is at Sharp Rehab after a motorcycle crash on the 805. The other driver’s insurer offered their $100,000 limit. Should we take it?
Not before identifying every other source of recovery and notifying your UIM carrier for consent. Accepting the limits releases the driver; if the driver has assets or an umbrella policy, or was working, those avenues close. A catastrophic claim requires that search first.
My husband is a Marine and was hurt as a passenger in a civilian car. Does the Navy recover from our settlement?
The federal government has a right under the Federal Medical Care Recovery Act to recover the cost of military medical care from the at-fault party or the settlement. It is typically resolved as a lien, often with negotiation.
Will a settlement end my Medi-Cal and IHSS?
It can, unless structured through a special needs trust or similar arrangement. Plan this before settlement; it cannot be fixed afterward.
